This year marks the 50th anniversary of the Supreme Court's Loving v. Virginia case that struck down laws prohibiting interracial marriage. Fifty years later, it seems absurd to most of us that such laws ever existed in the first place. In June, many Americans marked Loving Day —an annual gathering to fight racial prejudice through a celebration of multiracial community. The event takes its name from the Supreme Court ruling in Loving v. Many decried it as judicial overreach and resisted its implementation for decades.

Nevertheless, Judge Carlton Reeves, an Obama appointee, wrote a lengthy, fiery opinion full of fresh nuance and points despite the dozens of similar rulings in other states. Before even addressing the law, he opened with an impassioned plea for the equality same-sex couples are seeking under the law:. In reviewing the arguments of the parties and conducting its own research, the court determined that an objective person must answer affirmatively to the following questions:. Martin Luther King, Jr. Mississippi continues to reinforce stigma against gays and lesbians in many ways. And Reeves was not compelled by the idea that the law should wait for people to come around, citing a survey that found that nearly half of Mississippi Republicans still oppose interracial marriage.

Interracial Marriage in "Post-Racial" America

You are wrong on two points Martin. First, the same justification was given for both anti-miscegenation laws and the ban on same-sex marriage: the Bible. Preachers such as Jerry Falwell insisted race-mixing was against God's will as expressed in the Bible. Second, your claim about laws is simply wrong. There was no opposition to anti-miscegenation laws when they were enacted, so laws had to be changed to make mixed-race marriages legal.
This Essay examines the claim for religious or moral exemptions in a broader social and historical context. Would the claim for exemptions logically support exemptions from antidiscrimination laws in the case of discrimination against single and partnered gays? Why should gays be treated differently from every other group protected by antidiscrimination laws, including Americans of African descent and women? Can a claim for a religious exemption in the case of gay marriage be supported on the theory that a religious and biblical rationale was absent in the case of racial discrimination, but is present in the case of gays?
